There is hereby established a body to be known as the Securities
and

The Commission shall be a body corporate with power to sue

《重庆市营业性演出管理办法》已经2000年3月17日市人民政府第55次常务会议审议通过,现予发布,自发布之日起施行。

重庆市营业性演出管理办法
第一章 总 则
第一条 为了加强对营业性演出的管理,活跃演出市场,满足人民群众文化生活的需求,根据国务院《营业性演出管理条例》等有关法律法规,结合本市实际,制定本办法。
第二条 凡在本市行政区域内从事营业性演出活动、实施对营业性演出活动的监督管理,适用本办法。
第三条 本办法所称营业性演出是指演出的表演者或组织者以获取款、物或广告效益为目的的演出活动,包括以下方式:
(一)售票或包场;
(二)支付演出单位或个人演出费用;
(三)以演出为媒介进行广告宣传;
(四)有赞助或捐助;
(五)以演出吸引观众,为其他经营活动服务;
(六)利用体育比赛等形式邀请演艺人员进行现场表演活动;
(七)以其他经营方式演出。
第四条 市文化行政部门是本市营业性演出的主管部门,负责管理本市的营业性演出工作,其职责是:
(一)确定本行政区域内演出单位的总量、布局和结构;
(二)审批演出经纪机构、演出场所、以及冠以“重庆”、“巴渝”等字样的营业性文艺表演团体;
(三)审查、核准涉外演出;
(四)审批跨省市组台演出活动;
(五)对审批的演出活动实施现场监督。
区县(自治县、市)文化行政部门按本办法规定负责管理营业性演出工作,其职责是:
(一)负责管理本行政区域内的市内演员演出和歌舞娱乐场所演出;
(二)审批本行政区域内的营业性艺术表演团体和个人资格;
(三)审批本行政区域内的演出场所;
(四)对审批的演出活动进行现场监督。
公安机关、工商行政管理部门按照各自的职责分工,依法管理本行政区域内的营业性演出活动。
第二章 经营资格
第五条 申请设立营业性文艺表演团体、营业性演出场所以及个体演员从事营业性演出活动,应具备《营业性演出管理条例》和《营业性演出管理条例实施细则》所列条件,并依法向有权机关报批。
第六条 申请设立演出经纪机构,须依法报经市文化行政部门批准或核准报文化部批准,领取《营业性演出许可证》,并持证向工商行政管理部门申请注册登记,取得营业执照后,方可按许可证核定的范围从事演出经纪活动。未取得演出经纪机构的资格的单位和个人不得从事营业性演出经纪活动。
第七条 申请设立营业性演出场所,除应当具备《营业性演出管理条例》和《营业性演出管理条例实施细则》所列条件外,还应具备健全的演出、票务、财务、服务等管理制度。
第八条 歌舞娱乐场所申请兼营演出业务的,应按有关规定申领《营业性演出许可证》,并设立专门机构负责演出业务。
第九条 营业性演出许可证每年验审一次。演出单位或个人一年内无正当理由未从事营业性演出的,由原发证机关注销其营业性演出许可证。
第十条 县级以上文化行政部门在材料齐备的条件下办理每项审批不得超过10个工作日。
第三章 演出审批
第十一条 本市的营业性文艺表演团体和个人在市内从事营业性演出的,持《营业性演出许可证》、《演员个人营业性演出许可证》,报演出地县级以上文化行政部门审批。
第十二条 营业性文艺表演团体、个人跨省从事营业性组台演出,持《营业性演出许可证》、《演员个人营业性演出许可证》和所在地省、自治区、直辖市文化行政部门的介绍信,报市文化行政部门审批,开具演出介绍信,方可按规定的地点、时限、场次进行演出。
第十三条 歌舞娱乐场所邀请市外演员演出的,由批准歌舞娱乐场所的文化行政部门批准。
餐饮娱乐或其他没有《营业性演出许可证》的场所邀请市内演员演出的,报所在地文化行政部门审批。
第十四条 举办全市性营业性演出活动,应当报市文化行政部门审批。举办冠以“西南”、“巴渝”、“全市”、“重庆”等字样的营业性演出活动,应当报市文化行政部门审批。
第十五条 组织募捐义演活动的主办单位须持上级主管部门批准文件,报县级以上文化行政部门批准,除按规定扣除必要的成本开支外,其收入须全部交付受捐单位,由受捐单位签收。任何单位和个人不得从中提取报酬。组织社会福利性募捐演出、救助灾害及救济贫困性质的募捐,应经县级以上民政部门核准后,报同级文化行政部门审批。
第十六条 涉外演出应由具有涉外演出经纪资格的演出经纪机构承办并在演出前60日提出申请。涉外演艺人员进入歌舞娱乐场所演出的,也可由经批准的涉外定点场所提出申请,经市文化行政部门审核合格后,由市文化行政部门向国务院文化行政部门申报。
第十七条 申请涉外演出除应提供《营业性演出管理条例》和《营业性演出管理条例实施细则》所列资料外,还应提供以下资料:
(一)演出主、承办单位的《营业性演出许可证》或定点演出场所的有关资料;
(二)拟公开发布的广告稿。
第十八条 涉外演出项目报经国务院文化行政部门批准后,演出经纪机构或定点场所应按规定到市文化行政部门办理演出手续,取得《临时营业性演出许可证》,严格按照批文的规定实施演出。演出内容(包括演出服饰)要与送审的录象带相符。
经批准的涉外演出项目如变更节目、演员、演出时间、地点,主、承办单位,应按程序另行报批。
第十九条 涉外演出项目经国务院文化行政部门批准后,演出经纪机构应与涉外演出方经纪人依照经批准的意向书签订正式的演出合同,经提交市文化行政部门核准后,将合同副本报市文化行政部门和国务院文化行政部门备案。
第四章 演出管理
第二十条 演出单位应建立健全规章制度,演出单位和个人应遵守职业道德,按照商定的演出节目和程序演出。
第二十一条 演出经纪机构不得设立分支机构或转包经营。不得搞挂名承办,不得倒卖或变相倒卖演出批文。
第二十二条 演出单位变更名称、住所、主要负责人或法定代表人、业务范围,或者终止经营的,应当向原发证机关申请办理变更或者注销手续。
第二十三条 演员不得无证或手续不全参加演出,不得参与非法演出活动。
第二十四条 举办营业性演出活动,演出单位之间、演出单位与所邀请的演员之间应当签订演出合同。邀请在职演员演出的,还应与其所在单位签订演出合同。非演出经纪机构需要举办组台演出或涉外演出的,应当与演出经纪机构签订演出合同。
第二十五条 订立演出合同应当合法。合同订立后,应报文化行政部门备案。
按国家规定应当批准的演出活动,必须在其演出活动获得批准后合同方可生效;变更经批准演出内容的,应当按规定重新报批演出。
第二十六条 国家机关举办公益性演出活动,以获取款、物或广告效益弥补资金不足的,应按营业性演出管理规定办理审批手续。国家机关不得从中提取演出收入。
第二十七条 营业性演出广告须经核准其演出的文化行政部门审核后方可发布。
广告必须真实、合法,不得误导、欺骗观众。
新闻媒体机构应核验文化行政部门出具的《演出广告审查表》之后,方可发布营业性演出广告。
第二十八条 承办涉外演出的演出经纪机构,应在演出前将文化行政部门同意演出的批文、演出合同副本及纳税人责任书或办理代扣代缴责任人等有关资料报送当地税务部门。
第二十九条 演出活动须在批准的场所进行。不得将涉外演出团体分散组队演出,不得随意串场。未经公安机关批准,不得到未对其开放的地区演出。
第三十条 演出团体中的涉外人员应持有我国政府主管机关签发的相关签证,并按规定办理有关手续。
留学生、来华访问、旅游的外国人不得参加营业性演出或者在歌舞娱乐场所参加营业性演出活动。
第五章 法律责任
第三十一条 有下列情形之一的,由县以上文化行政部门依照各自权限按《营业性演出管理条例》予以处罚:
(一)未经批准,擅自设立营业性演出单位的,或者未取得营业性演出许可,从事营业性演出的;
(二)演出国家禁止内容的;
(三)擅自举办组台演出或者擅自邀请港、澳、台地区及外国文艺表演团体或者个人从事任何形式的营业性演出的;
(四)无理中止演出或者以假唱、假冒他人名义等手段弄虚作假,违反演出合同的;
(五)营业性演出场所违反规定,擅自接纳无《营业性演出许可证》的营业性文艺表演团体、演出经纪机构组织的演出或者未经批准的营业性演出活动的;
(六)营业性演出场所违反规定,致使演出秩序混乱或者发生安全事故的;
(七)侵吞募捐演出收入的;
(八)营业性文艺表演团体或演出经纪机构擅自聘请未事先征得其所在单位同意的人员或者未取得《营业性演出许可证》的个人参加营业性演出的;
(九)演员未经本单位同意擅自参加营业性演出的;
(十)个体演员擅自举办营业性演出的;
(十一)出租、转让《营业性演出许可证》的;
第三十二条 演出单位未经批准,办理变更或注销手续,擅自变更名称、住所、主要负责人、法定代表人、业务范围或终止经营的,除责令限期整改外,并处以20000元以下的罚款。
第三十三条 演出主、承办单位未另行报批,擅自变更其节目、演出时间、地点的,处以非法所得金额1倍至3倍的罚款,最低不少于2000元。
第三十四条 演出经纪机构违反规定,设立分支机构或转包经营、搞挂名承办、倒卖或变相倒卖演出批文的,处以非法所得金额1倍至5倍的罚款,最低不少于30000元。
第三十五条 涉外演出人员未持我国政府机关签发的相关签证,按规定办理有关手续或有留学生、来华访问、旅游的外国人参加营业性演出的,对组织或参加演出的单位或个人,分别处5000元以上20000元以下的罚款。
第三十六条 文化行政部门发现未经核准演出而发布营业性演出广告的,移交工商行政部门依法查处。演出单位违反演出合同的,应当依法承担违约责任。给观众造成损失的,应当予以赔偿。
第三十七条 违反本办法第十三条规定的,由文化行政部门对演出单位给予警告,并处以20000元以下的罚款。
第三十八条 违反本办法的行为,法律法规有规定的,从其规定。
第三十九条 文化行政部门及其工作人员违反法律、法规规定,侵犯演出单位或者个体演员合法权益,在营业性演出管理工作中滥用职权,玩忽职守,徇私舞弊,参与、包庇违法演出活动,参与或变相参与营业性演出经营活动的,依法给予责任人行政处分。构成犯罪的,依法追究刑事责任。
第六章 附 则
第四十条 文化行政部门按照国家有关规定收取的文化市场管理费,应实行“收支两条线”管理。
第四十一条 本办法的具体应用问题,由市文化行政管理部门负责解释。
第四十二条 本办法自发布之日起施行。
