  2002年5月25日内蒙古自治区第九届人民代表大会常务委员会第三十次会议通过《内蒙古自治区实施〈中华人民共和国体育法〉办法》,自2002年10月1日起施行。

第一章 总  则

  第一条 根据《中华人民共和国体育法》和国家有关法律、法规,结合自治区实际,制定本办法。
  第二条 自治区行政区域内的机关、企业事业组织、社会团体和个人开展体育活动,从事体育事业,应当遵守本办法。
  第三条 各级人民政府应当加强对体育工作的领导,将体育事业纳入本地区国民经济和社会发展计划。
  第四条 旗县级以上人民政府体育行政部门或者本级人民政府授权的机构主管本行政区域内的体育工作,其他有关部门在各自职权范围内管理体育工作。
  第五条 自治区鼓励企业事业组织、社会团体和个人兴办、支持体育事业,推进体育社会化和体育产业化进程。
  第六条 自治区鼓励和扶持少数民族体育事业的发展。积极开展民族传统体育运动,挖掘和发展民族、民间传统体育项目,培养和选拔少数民族体育人才。
  第七条 各级人民政府对在组织、从事、支持体育事业中作出突出贡献的组织和个人给予奖励。

第二章 社会体育与体育社会团体

  第八条 各级人民政府应当根据国家全民健身计划编制本地区实施方案并组织实施。
  自治区实行社会体育督导制度,建立社会体育督导机制。
  第九条 社会体育活动应当坚持业余、自愿、小型多样,遵循因地制宜和科学文明的原则。
  各级人民政府应当为公民参加社会体育活动创造必要条件,普及体育健身知识和技能,推广科学健身项目和方法,支持、扶助群众性体育活动的开展。
  第十条 机关、企业事业组织、社会团体和其他组织应当投入一定的经费,配备体育设施,结合各自特点,坚持开展多种形式的体育活动,保障职工参加体育锻炼的基本权益。
  第十一条 各级工会、共青团、妇联应当根据各自特点,开展群众性体育健身和竞赛活动。
  第十二条 城市街道办事处和苏木乡镇人民政府应当配备专职或者兼职体育工作人员,组织群众开展适合城市社区和农牧区特点的体育活动,加强对群众性体育指导站和健身活动点的管理、指导。
  第十三条 全社会应当关心、支持老年人、残疾人参加体育活动。各级人民政府应当采取措施,为老年人、残疾人参加体育活动提供方便。
  各级老年人、残疾人组织应当积极开展适合老年人、残疾人特点的体育健身和竞赛活动。
  第十四条 旗县级以上人民政府体育行政部门应当建立健全国民体质监测系统,按照国家和自治区规定的标准组织国民体质测定,并向社会公布监测结果。
  第十五条 自治区实行社会体育指导员技术等级制度。社会体育指导员资格由旗县级以上人民政府体育行政部门依据国家标准考核、认证。
  《社会体育指导员国家职业标准》由自治区人民政府体育行政部门组织实施。
  第十六条 体育社会团体的设立,应当经同级人民政府体育行政部门审核同意,由民政部门注册登记。
  体育社会团体应当接受人民政府体育行政部门的指导、监督,按照其章程组织和开展体育活动。
  第十七条 各级单项体育协会应当承担管理该运动项目普及与提高工作的职责,在协议基础上对本项目的运动员实行注册管理并向上级单项体育协会注册登记。经注册的运动员可以按照有关规定参加体育竞赛和运动队之间的人员流动。
  第十八条 各级人民政府要积极组织开展各种形式的民族、民间传统体育活动和竞赛,适时召开民族传统体育运动会。

第三章 学校体育

  第十九条 各级人民政府教育、体育行政部门应当加强对学校体育工作的管理、指导和监督。
  第二十条 学校必须开设体育课程,实施国家体育锻炼标准,经常举行体育竞赛活动,每学年至少举行一次以田径项目为主的运动会。
  体育课应当列为考核学生学业成绩的科目,考试成绩作为学生毕业、升学的依据之一。对有体育特长,成绩突出的学生,按照有关规定加分或者免试升入高一级学校学习。
  学校应当为病残学生安排适合其特点的体育活动。
  第二十一条 少数民族聚居地区的学校,应当根据当地实际情况将民族传统体育项目纳入体育课程内容,开展民族传统体育项目比赛。
  第二十二条 学校应当按照国家有关规定配备合格体育教师,加强对体育教师的培养、培训工作。
  第二十三条 各级人民政府教育、体育行政部门应当加强对各级各类学校课余体育训练工作的业务指导、管理。
  学校应当加强课余体育训练工作,逐步提高学生体育运动技术水平,培养和选拔具有体育特长的体育骨干和后备人才。
  第二十四条 各级人民政府教育、体育行政部门应当采取教育与体育相结合的办法,加强青少年体育组织建设。
  盟市和有条件的旗县(区)应当建立青少年体校或者培训班。青少年体校应当纳入九年义务教育范畴,保证学生接受义务教育。
  积极组织建立青少年体育俱乐部,吸引青少年参加体育训练。
  第二十五条 各级人民政府教育行政部门应当按照有关标准,将学校体育设施和体育教学器材、设备的配置纳入学校建设计划。
  学校体育设施在法定节假日和寒、暑假期间应当向学生开放;学校体育设施不得挪作他用,任何组织和个人不得侵占。

第四章 竞技体育

  第二十六条 自治区对体育竞赛实行分级分类管理,申报登记的体育活动实行经济担保,具体办法由自治区人民政府制定。
  第二十七条 举办国际性或者全国性的体育活动,举办者应当向自治区人民政府体育行政部门申报登记,审核同意后方可按照国家和自治区的有关规定办理审批手续。
  第二十八条 自治区内举办的重大体育活动,其名称、徽记、旗帜、吉祥物等标志和相关用语按照国家有关规定予以保护。
  第二十九条 体育竞赛的组织者和运动员、教练员、裁判员应当遵守体育道德,不得弄虚作假、营私舞弊、行贿受贿,不得使用禁用药物和方法。
  第三十条 各级人民政府应当支持青少年业余体育训练工作,对高水平后备人才训练基地予以重点扶持,对参加课余训练并在上一级体育竞赛获得录取名次的注册运动员,应当给予训练补贴。
  鼓励、支持社会组织和个人组建运动项目队,开展业余训练,培养优秀体育后备人才。
  第三十一条 加强自治区优秀运动队和教练员、裁判员队伍建设,对运动员进行爱国主义、集体主义和社会主义教育,进行道德和纪律教育,注重文化知识和适用技能的培养。
  第三十二条 自治区建立运动员奖励输送基金。运动员奖励输送基金来源于政府拨款、社会捐助和运动员有偿流动所得。
  第三十三条 注册运动员向其他省、自治区、直辖市流动应当按照有关规定进行。运动员流动办法和引进政策由自治区人民政府制定。
  第三十四条 各级人民政府和有关部门应当对优秀运动员就业和升学方面给予优待。对退役的优秀运动员,要给予妥善安置。具体安置办法和优待条件由自治区人民政府制定。

第五章 保障条件

  第三十五条 各级人民政府应当重视发展体育事业,在组织管理、经费投入、设施建设等方面给予保障和支持。
  旗县级以上人民政府应当将体育事业经费、体育基本建设资金列入本级财政预算和基本建设投资计划,并逐步增加对体育事业的投入。
  各级人民政府应当设立全民健身专项资金。
  第三十六条 各级人民政府体育行政部门应当加强对体育资金的管理,财政、审计等部门在各自职权范围内加强对体育资金的使用监督,任何组织和个人不得挪用、克扣。
  第三十七条 各级人民政府应当按照国家对城镇公共体育设施用地定额指标的规定,将城镇公共体育设施建设纳入城镇建设规划和土地利用总体规划,合理布局,统一安排。
  第三十八条 城镇新建居民区和旧居民区改造的配套公共体育设施用地,由当地人民政府按照人均不低于02平方米的用地定额指标统一规划,公共体育设施建设与住宅区的主体工程同步进行。
  城市街道办事处和苏木乡镇,应当建设一定规模的室内体育活动室和室外体育活动场地,为群众参加社会体育活动创造条件。
  第三十九条 各级人民政府应当加强公共体育设施的维护,保障公共体育设施维修所需费用。
  根据城市规划改变公共体育设施用途或者对设施进行拆除时,必须按照“拆一补一”的原则,先行择地新建或者先行补偿费用,补偿费用必须专款专用。
  第四十条 企业事业组织、其他组织和个人向公共体育事业捐赠资金或者设施、设备,可以按照国家有关规定享受税收优惠。向公共体育事业捐赠的资金应当纳入体育资金管理。

第六章 法律责任

  第四十一条 有下列行为之一的,由当地人民政府或者教育行政部门责令限期改正,并视情节轻重对直接责任人员给予行政处分:
  (一)不按规定开设或者随意停止体育课、常年不开展课余训练和不组织体育竞赛活动的;
  (二)不按规定配备体育教师的;
  (三)出具虚假体育成绩证明的。
  第四十二条 有下列行为之一的,应当依照《中华人民共和国体育法》和其他有关规定给予处罚;构成犯罪的,依法追究刑事责任:
  (一)在竞技体育中弄虚作假、营私舞弊、行贿受贿,违反比赛纪律和竞赛规则的;
  (二)在体育运动中使用禁用的药物和方法的;
  (三)违反运动员注册管理和运动员交流规定的;
  (四)挪用、克扣体育资金的。
  第四十三条 有下列行为之一的,由上级人民政府或者体育行政部门责令限期改正:
  (一)城镇公共体育设施建设用地达不到国家规定标准的;
  (二)改变公共体育设施用途或者拆除,而未按“拆一补一”原则新建或者补偿的。
  第四十四条 体育行政部门或者授权管理体育工作机构的工作人员玩忽职守、滥用职权、徇私舞弊的,由其所在单位或者上级主管部门依法给予行政处分;构成犯罪的,依法追究刑事责任。

第七章 附  则

  第四十五条 本办法自2002年10月1日起施行。

  nterpretation
  his Ordinance, unless the context otherwise requires-

 PART II SECURITIES AND FUTURES COMMISSION
  
  ecurities and Futures Commission
  There is hereby established a body to be known as the Securities 
and
  res Commission.
  The Commission shall be a body corporate with power to sue 
and be
  . (3) The receipts of the Commission shall not be subject to
taxation
  r the Inland Revenue Ordinance (Cap. 112).
  (a) The Commission shall provide itself with a seal.
  The seal of the Commission shall be authenticated by the signature 
of
  chairman or deputy chairman of the Commission or, if both the
chairman
  deputy chairman of the Commission are absent from Hong Kong or 
unable
  ct, the signature of some other director of the Commission 
authorized
  t to act in that behalf.
  
  unctions of Commission
  The Commission shall have the following functions--
  to advise the Financial Secretary on all matters 
relating to
  rities, futures contracts and property investment arrangements;
  without prejudice to any duties imposed or powers conferred 
on any
  r person in regard to the enforcement of the law 
relating to
  rities, futures contracts and property investment arrangements,
to be
  onsible for ensuring that the provisions of the relevant 
Ordinances,
  the provisions of any other Ordinance so far as they 
relate to
  rities, futures contracts and property investment 
arrangements, are
  lied with;
  to report to the Financial Secretary the occurrence of any dealing 
in
  tion to securities which it reasonably believes or suspects to 
be an
  der dealing within the meaning of section 9 of the Securities
(Insider
  ing) Ordinance (Cap. 395); (Amended 62 of 1990 s. 42)
  to be responsible for supervising and monitoring the activities
of the
  ange Companies and clearing houses;
  to take all reasonable steps to safeguard the interests of 
persons
  ing in securities or trading in futures contracts or entering 
into
  erty investment arrangements;
  to promote and encourage proper conduct amongst members 
of the
  ange Companies and clearing houses, and other registered persons;
  to suppress illegal, dishonourable and improper practices in 
dealing
  ecurities, trading in futures contracts, entering into 
property
  stment arrangements, and the provision of investment advice or 
other
  ices relating to securities, futures contracts and property
investment
  ngements;
  to promote and maintain the integrity of registered 
persons and
  urage the promulgation by registered persons of balanced and 
informed
  ce to their clients and to the public generally;
  to consider and suggest reforms of the law relating to 
securities,
  res contracts and property investment arrangements;
  to encourage the development of securities and futures markets
in Hong
  and the increased use of such markets by investors in Hong Kong 
and
  where; (k) to promote and develop self-regulation by market
bodies in
  securities and futures industries;
  subject to the provisions of this Ordinance, to co-operate with 
and
  st authorities or regulatory organizations, in Hong Kong or
elsewhere,
  are concerned with securities and futures, or with banking,
insurance
  ther financial services or with the affairs of corporations;

  to perform any other functions conferred by or under 
any other
  nance.
  As regards any function, the Commission may, for the 
guidance of
  stered persons and others, prepare and cause to be published in 
the
  tte guidelines indicating the manner in which, in the absence of 
any
  icular consideration or circumstance, it proposes to 
perform the
  tion.
  The Commission may from time to time engage such 
consultants or
  sers as it may consider necessary to assist the Commission 
in the
  ormance of its functions. (4) Nothing in subsection (1) (k)
shall be
  rded as limiting or otherwise affecting any other function 
of the
  ission.
  
  onstitution of Commission
  Subject to subsection (2), the Commission shall consist of a 
chairman
  inted by the Governor and such uneven number, not being less than 
7,
  ther directors so appointed as the Governor may determine; and 
when
  number of such other directors ceases to be an uneven 
number the
  rnor shall make such appointment or appointments as may be 
necessary
  omply with this subsection.
  Half of the directors of the Commission, including the chairman,
shall
  ppointed to be executive directors and the remainder 
shall be
  inted to be non-executive directors.
  The Governor may appoint an executive director to be deputy 
chairman
  he Commission.
  (a) If no appointment has been made under subsection (3) or if 
the
  ce of deputy chairman of the Commission is vacant, the 
Financial
  etary may designate an executive director to act as chairman of 
the
  ission during any period during which the chairman of the 
Commission
  nable to act as chairman due to illness or other incapacity 
or is
  nt from Hong Kong.
  A designation under this subsection shall cease when revoked 
by the
  ncial Secretary or an appointment is made under 
subsection (3),
  hever first occurs. (5) The terms and conditions of office 
of a
  ctor of the Commission shall be such as the Governor may
determine.
  A director of the Commission may at any time resign his 
office by
  er sent to the Governor.
  A director of the Commission shall be paid by the Commission 
such
  neration, allowances or expenses as the Governor may determine.
  The Governor may by notice in writing remove from office any 
director
  he Commission whose removal appears to him to be desirable 
for the
  ctive performance by the Commission of its functions.
  Meetings of the Commission shall be held as often as may be 
necessary
  the performance of its functions, and may be convened by the 
chairman
  he deputy chairman or any 2 other directors.
  If the office of chairman of the Commission is vacant or the
chairman
  he Commission is unable to act as chairman due to illness or 
other
  pacity or is absent from Hong Kong the deputy chairman or an
executive
  ctor designated under subsection (4) shall act as chairman 
in his
  e.
  At a meeting of the Commission--
  the chairman shall be chairman of the meeting; or
  if the chairman is not present, the deputy chairman shall be 
chairman
  he meeting; or
  if neither the chairman nor the deputy chairman is 
present, the
  ctors present shall choose one of their number to be chairman of 
the
  ing.
  The quorum for a meeting of the Commission shall be 4 directors 
of
  2 shall be executive directors and 2 shall be non-
executive
  ctors.
  Each director of the Commission present at a meeting thereof 
shall
  a vote. (14) (a) Every question for decision at a meeting of 
the
  ission shall be determined by a majority of votes of the 
directors
  ent and, in the event that voting is equally divided, 
subject to
  graph (b) the chairman of the meeting shall have a casting vote. 
(b)
  chairman of a meeting shall not exercise a casting vote until
after he
  consulted the Financial Secretary as regards that exercise.

第一章 总 则
第一条 为了加强对营业性演出的管理,活跃演出市场,满足人民群众文化生活的需求,根据国务院《营业性演出管理条例》等有关法律法规,结合本市实际,制定本办法。
第二条 凡在本市行政区域内从事营业性演出活动、实施对营业性演出活动的监督管理,适用本办法。
第三条 本办法所称营业性演出是指演出的表演者或组织者以获取款、物或广告效益为目的的演出活动,包括以下方式:
(一)售票或包场;
(二)支付演出单位或个人演出费用;
(三)以演出为媒介进行广告宣传;
(四)有赞助或捐助;
(五)以演出吸引观众,为其他经营活动服务;
(六)利用体育比赛等形式邀请演艺人员进行现场表演活动;
(七)以其他经营方式演出。
第四条 市文化行政部门是本市营业性演出的主管部门,负责管理本市的营业性演出工作,其职责是:
(一)确定本行政区域内演出单位的总量、布局和结构;
(二)审批演出经纪机构、演出场所、以及冠以“重庆”、“巴渝”等字样的营业性文艺表演团体;
(三)审查、核准涉外演出;
(四)审批跨省市组台演出活动;
(五)对审批的演出活动实施现场监督。
区县(自治县、市)文化行政部门按本办法规定负责管理营业性演出工作,其职责是:
(一)负责管理本行政区域内的市内演员演出和歌舞娱乐场所演出;
(二)审批本行政区域内的营业性艺术表演团体和个人资格;
(三)审批本行政区域内的演出场所;
(四)对审批的演出活动进行现场监督。
公安机关、工商行政管理部门按照各自的职责分工,依法管理本行政区域内的营业性演出活动。

第二章 经营资格
第五条 申请设立营业性文艺表演团体、营业性演出场所以及个体演员从事营业性演出活动,应具备《营业性演出管理条例》和《营业性演出管理条例实施细则》所列条件,并依法向有权机关报批。
第六条 申请设立演出经纪机构,须依法报经市文化行政部门批准或核准报文化部批准,领取《营业性演出许可证》,并持证向工商行政管理部门申请注册登记,取得营业执照后,方可按许可证核定的范围从事演出经纪活动。未取得演出经纪机构的资格的单位和个人不得从事营业性演出经纪活动。
第七条 申请设立营业性演出场所,除应当具备《营业性演出管理条例》和《营业性演出管理条例实施细则》所列条件外,还应具备健全的演出、票务、财务、服务等管理制度。
第八条 歌舞娱乐场所申请兼营演出业务的,应按有关规定申领《营业性演出许可证》,并设立专门机构负责演出业务。
第九条 营业性演出许可证每年验审一次。演出单位或个人一年内无正当理由未从事营业性演出的,由原发证机关注销其营业性演出许可证。
第十条 县级以上文化行政部门在材料齐备的条件下办理每项审批不得超过10个工作日。

第三章 演出审批
第十一条 本市的营业性文艺表演团体和个人在市内从事营业性演出的,持《营业性演出许可证》、《演员个人营业性演出许可证》,报演出地县级以上文化行政部门审批。
第十二条 营业性文艺表演团体、个人跨省从事营业性组台演出,持《营业性演出许可证》、《演员个人营业性演出许可证》和所在地省、自治区、直辖市文化行政部门的介绍信,报市文化行政部门审批,开具演出介绍信,方可按规定的地点、时限、场次进行演出。
第十三条 歌舞娱乐场所邀请市外演员演出的,由批准歌舞娱乐场所的文化行政部门批准。
餐饮娱乐或其他没有《营业性演出许可证》的场所邀请市内演员演出的,报所在地文化行政部门审批。
第十四条 举办全市性营业性演出活动,应当报市文化行政部门审批。举办冠以“西南”、“巴渝”、“全市”、“重庆”等字样的营业性演出活动,应当报市文化行政部门审批。
第十五条 组织募捐义演活动的主办单位须持上级主管部门批准文件,报县级以上文化行政部门批准,除按规定扣除必要的成本开支外,其收入须全部交付受捐单位,由受捐单位签收。任何单位和个人不得从中提取报酬。组织社会福利性募捐演出、救助灾害及救济贫困性质的募捐,应经县级以上民政部门核准后,报同级文化行政部门审批。
第十六条 涉外演出应由具有涉外演出经纪资格的演出经纪机构承办并在演出前60日提出申请。涉外演艺人员进入歌舞娱乐场所演出的,也可由经批准的涉外定点场所提出申请,经市文化行政部门审核合格后,由市文化行政部门向国务院文化行政部门申报。
第十七条 申请涉外演出除应提供《营业性演出管理条例》和《营业性演出管理条例实施细则》所列资料外,还应提供以下资料:
(一)演出主、承办单位的《营业性演出许可证》或定点演出场所的有关资料;
(二)拟公开发布的广告稿。
第十八条 涉外演出项目报经国务院文化行政部门批准后,演出经纪机构或定点场所应按规定到市文化行政部门办理演出手续,取得《临时营业性演出许可证》,严格按照批文的规定实施演出。演出内容(包括演出服饰)要与送审的录象带相符。
经批准的涉外演出项目如变更节目、演员、演出时间、地点,主、承办单位,应按程序另行报批。
第十九条 涉外演出项目经国务院文化行政部门批准后,演出经纪机构应与涉外演出方经纪人依照经批准的意向书签订正式的演出合同,经提交市文化行政部门核准后,将合同副本报市文化行政部门和国务院文化行政部门备案。

第四章 演出管理
第二十条 演出单位应建立健全规章制度,演出单位和个人应遵守职业道德,按照商定的演出节目和程序演出。
第二十一条 演出经纪机构不得设立分支机构或转包经营。不得搞挂名承办,不得倒卖或变相倒卖演出批文。
第二十二条 演出单位变更名称、住所、主要负责人或法定代表人、业务范围,或者终止经营的,应当向原发证机关申请办理变更或者注销手续。
第二十三条 演员不得无证或手续不全参加演出,不得参与非法演出活动。
第二十四条 举办营业性演出活动,演出单位之间、演出单位与所邀请的演员之间应当签订演出合同。邀请在职演员演出的,还应与其所在单位签订演出合同。非演出经纪机构需要举办组台演出或涉外演出的,应当与演出经纪机构签订演出合同。
第二十五条 订立演出合同应当合法。合同订立后,应报文化行政部门备案。
按国家规定应当批准的演出活动,必须在其演出活动获得批准后合同方可生效;变更经批准演出内容的,应当按规定重新报批演出。
第二十六条 国家机关举办公益性演出活动,以获取款、物或广告效益弥补资金不足的,应按营业性演出管理规定办理审批手续。国家机关不得从中提取演出收入。
第二十七条 营业性演出广告须经核准其演出的文化行政部门审核后方可发布。
广告必须真实、合法,不得误导、欺骗观众。
新闻媒体机构应核验文化行政部门出具的《演出广告审查表》之后,方可发布营业性演出广告。
第二十八条 承办涉外演出的演出经纪机构,应在演出前将文化行政部门同意演出的批文、演出合同副本及纳税人责任书或办理代扣代缴责任人等有关资料报送当地税务部门。
第二十九条 演出活动须在批准的场所进行。不得将涉外演出团体分散组队演出,不得随意串场。未经公安机关批准,不得到未对其开放的地区演出。
第三十条 演出团体中的涉外人员应持有我国政府主管机关签发的相关签证,并按规定办理有关手续。
留学生、来华访问、旅游的外国人不得参加营业性演出或者在歌舞娱乐场所参加营业性演出活动。

第五章 法律责任
第三十一条 有下列情形之一的,由县以上文化行政部门依照各自权限按《营业性演出管理条例》予以处罚:
(一)未经批准,擅自设立营业性演出单位的,或者未取得营业性演出许可,从事营业性演出的;
(二)演出国家禁止内容的;
(三)擅自举办组台演出或者擅自邀请港、澳、台地区及外国文艺表演团体或者个人从事任何形式的营业性演出的;
(四)无理中止演出或者以假唱、假冒他人名义等手段弄虚作假,违反演出合同的;
(五)营业性演出场所违反规定,擅自接纳无《营业性演出许可证》的营业性文艺表演团体、演出经纪机构组织的演出或者未经批准的营业性演出活动的;
(六)营业性演出场所违反规定,致使演出秩序混乱或者发生安全事故的;
(七)侵吞募捐演出收入的;
(八)营业性文艺表演团体或演出经纪机构擅自聘请未事先征得其所在单位同意的人员或者未取得《营业性演出许可证》的个人参加营业性演出的;
(九)演员未经本单位同意擅自参加营业性演出的;
(十)个体演员擅自举办营业性演出的;
(十一)出租、转让《营业性演出许可证》的;
第三十二条 演出单位未经批准,办理变更或注销手续,擅自变更名称、住所、主要负责人、法定代表人、业务范围或终止经营的,除责令限期整改外,并处以20000元以下的罚款。
第三十三条 演出主、承办单位未另行报批,擅自变更其节目、演出时间、地点的,处以非法所得金额1倍至3倍的罚款,最低不少于2000元。
第三十四条 演出经纪机构违反规定,设立分支机构或转包经营、搞挂名承办、倒卖或变相倒卖演出批文的,处以非法所得金额1倍至5倍的罚款,最低不少于30000元。
第三十五条 涉外演出人员未持我国政府机关签发的相关签证,按规定办理有关手续或有留学生、来华访问、旅游的外国人参加营业性演出的,对组织或参加演出的单位或个人,分别处5000元以上20000元以下的罚款。
第三十六条 文化行政部门发现未经核准演出而发布营业性演出广告的,移交工商行政部门依法查处。演出单位违反演出合同的,应当依法承担违约责任。给观众造成损失的,应当予以赔偿。
第三十七条 违反本办法第十三条规定的,由文化行政部门对演出单位给予警告,并处以20000元以下的罚款。
第三十八条 违反本办法的行为,法律法规有规定的,从其规定。
第三十九条 文化行政部门及其工作人员违反法律、法规规定,侵犯演出单位或者个体演员合法权益,在营业性演出管理工作中滥用职权,玩忽职守,徇私舞弊,参与、包庇违法演出活动,参与或变相参与营业性演出经营活动的,依法给予责任人行政处分。构成犯罪的,依法追究刑事责任。

第六章 附 则
第四十条 文化行政部门按照国家有关规定收取的文化市场管理费,应实行“收支两条线”管理。
第四十一条 本办法的具体应用问题,由市文化行政管理部门负责解释。
第四十二条 本办法自发布之日起施行。
